In consideration of being permitted to participate in a photography workshop sponsored by Wonderland Publishing Group, Inc., Shoot From The Pit, and/or David Bergman (together, the “Sponsor”), you, on behalf of yourself, your heirs, personal representatives, successors, and assigns, intending to be legally bound, agree as set forth below:
CANCELLATION BY SPONSOR
Sponsor reserves the right to alter or cancel any workshop, for any reason, and in such case, we will refund all monies paid, in full. Sponsor is not responsible for any travel expenses or non-refundable purchases, deposits, or reservations that you make to attend any workshop.
PAYMENT AND REFUND POLICY
Workshop registrations are accepted on a first come, first served basis. All workshop pricing is in U.S. dollars. All fees may be paid with a credit card on our website. Due to the exclusive nature and small size of our workshops, fees are non-refundable, although we may allow you to transfer your registration to a friend if you contact us first.
EQUIPMENT
Workshop participants must provide their own photography gear and other gear as specified in a workshop syllabus.
PARTICIPANT HEALTH AND PHYSICAL FITNESS
Our workshops are within the abilities of average people in good health. Please contact us if you have any questions or concerns about the activity levels of the workshops or if you need a reasonable accommodation. Some workshops require the ability to walk over uneven terrain while also carrying your photo gear. You certify that you do not knowingly have any physical condition or other condition or disability that would create a risk for you, the Sponsor, or other workshop participants or workshop staff.
RELEASE AND WAIVER OF LIABILITY
Sponsor, guest presenters, and workshop assistants aim to provide every participant a safe, educational, and enjoyable experience. In photography, as well as in any indoor/outdoor activity, there is always an element of risk of bodily injury, death, illness, and loss or damage to photography equipment and other personal property. These risks may be caused by your own actions, or inactions, or by the actions or inactions of others participating in the workshop, the conditions under which the workshop takes place, or even the negligence of the Sponsor. There may be other risks and social and economic losses either not known to you nor readily foreseeable at this time. By participating any workshop, you acknowledge that you are aware of these risks and are physically capable of safely taking part in the workshop. You fully accept and assume all such risks and all responsibility for personal injuries, losses, damages, costs, and expenses you may suffer or incur as a result of your participation in the workshop.
Sponsor assumes no liability for any act, error, omission, injury, loss, delay, mishap, or damage to persons or property arising from any cause during the course of the workshop or in transit thereto. It is your responsibility to obtain information about any risks involved. The types of workshops we offer require flexibility and must allow for alternatives. Workshops may take place in the studio or out in the real world. For this reason, the workshop description must be taken as an indication of what may take place, and not as a contractual obligation or definitive syllabus. Sponsor can accept no responsibility for losses or additional expenses due to delay or changes in the workshop services to be provided. Sponsor reserves the right to change any arrangements should conditions necessitate, or to cancel any aspect of the workshop due to exceptional circumstances.
You hereby release, discharge, and agree not to sue the Sponsor, its directors, officers and employees, any persons involved in organizing and promoting any workshop, Sponsor’s agents, volunteers, other participants, any other sponsors, advertisers, promoters, and, if applicable, owners and lessors of any premises on which the workshop takes place (together, the “Releasees”), from any liability for your injury, illness, or loss or damage to personal property or expenses associated with participation in a workshop, and all liability, claims, demands, losses or damages incurred as the result of your participation in the workshop (including, but not limited to claims, losses, or damage caused or alleged to be caused, in whole or in part, by the negligence of a Releasee or otherwise). You further agree that if, despite this release, you or anyone on your behalf, makes a claim against any of the Releasees, you will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which any of the Releasees may incur as the result of such claim.
PERMISSIONS AND USE OF NAME AND LIKENESS
Sponsor will secure the rights for you to use images that you capture during the workshop in your portfolio/website and on social media. For any third-party commercial use, you are responsible for obtaining any necessary permissions from subjects of your photographs taken during a workshop.
Sponsor reserves the right to take photographs or videos during the operation of any workshop or part thereof and to use the resulting photography and/or video in whole or in part for promotional purposes, including but not limited to advertising and publicity both in print and electronic media. By participating in a workshop, you agree to allow your image to be used in such photography/video for all purposes, in any form, and in any and all media, including, without limitation, advertising, solicitation, stock photography, or trade. You waive any right to inspect or approve the finished images, advertising copy, text, or other printed matter that may be used in conjunction therewith, or to the eventual use that the images may be applied. You release and discharge Sponsor and those acting under its authority from any and all liabilities, claims and demands arising out of or relating to any blurring, distortion, or alteration whether intentional or otherwise, that may occur or be produced in connection with the images, or in connection with any processing, alteration, transmission, display, or publication of the images. Sponsor also reserves the right to use, in all or in part, any written reviews you may provide to us in our advertising and publicity both in print and electronic media.
SUBSTANCE-FREE ENVIRONMENT
The possession and use of alcohol and illegal drugs, and the use of smoking and e-cigarette and other vapor products are prohibited in the workshop.
COVID WAIVER
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Sponsor cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending the workshop. Therefore, if you choose to attend, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
By attending the workshop, you choose to accept the risk of being exposed to, contracting, and/or spreading COVID-19. You hereby forever release and waive your right to bring suit against Sponsor in connection with exposure, infection, and/or spread of COVID-19 related to attending the workshop. This waiver means you give up your right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence, and give up any claim you may have to seek damages, whether known or unknown, foreseen or unforeseen.
ACCEPTANCE OF TERMS AND CONDITIONS
Your registration and payment verifies your release of liability of the Releasees, and you agree to all the above terms & conditions.
